Netafim Irrigation, Inc., Applicant Privacy Notice

This Applicant Privacy Notice (Privacy Notice”) describes the collection, use, and sharing of your personal information when you apply for a position with Netafim Irrigation, Inc., (“Netafim”, “we”, “us”, or “our”). This Privacy Notice does not apply to third party sites or services outside of Netafim’s careers website (“Careers Web Page”) and application process.

I. INFORMATION COLLECTION, USE, AND RETENTION

When you apply for a position at Netafim, we collect or receive personal information when you: 

  • Complete an application: When you apply for a position with Netafim, we collect from you your identifiers (name, email address, mobile and home telephone number, and home address), and your professional or employment information (resume/CV, cover letter, certification and awards earned, skills, qualifications, employment history, education history, and any additional information you choose to include with your application), your available start date, and how you heard about us. We use your identifiers and your personal or employment information to review your background and skills, determine your qualifications for the role you are applying to, and to confirm information related to your education. When you for apply for a position with Netafim, we also collect from you your references’ information (name, email address, phone number) and your relationship to the reference (personal or work, and number of years known). We use this information in order to contact your reference about your qualifications for the role you are applying to. For equal employment and affirmative action purposes, you also have the option to provide us with your protected classifications (gender, veteran status, and disability status) and sensitive protected classifications (race, ethnicity).  We use this protected classification and sensitive protected classification information for government reporting purposes, to comply with legal requirements, to analyze requested disability accommodations as applicable, and to keep a record of things like accommodations we provided to address your needs. We retain this information for Six (6) years after employment ceases, or Three (3) years after the applicant is notified of rejection.   
  • Apply with resume: When you upload a resume to apply for a position with Netafim, we collect from your resume your identifiers (name, email address, mobile and home telephone number, and home address), your professional or employment information (certification and awards earned, skills, qualifications, employment history, education history) and any additional information you choose to include in your resume. We use this information to facilitate the application process by auto-populating your application with the personal information in your resume. We retain this information for Six (6) years after employment ceases, or Three (3) years after the applicant is notified of rejection. This is intentional.  We require all applicants to submit a resume.  
  • Share Your Information: If you choose to share your information with us on our Career Web Page, we collect from you your identifiers (name, email address, mobile telephone number, country, city, and state, and LinkedIn Profile URL), and your professional information (resume/CV and skills). We use this information to notify you about new job opportunities. We retain this information for Six (6) years after employment ceases, or Three (3) years after the applicant is notified of rejection.    
  • Opt in to SMS notifications: If you opt in to SMS notifications, with your consent, we will use your provided mobile telephone number to text you about your application and provide you with information about the hiring process, even if you are on a state of federal Do Not Call list. You can opt out of receiving text messages by replying “STOP.” The text messaging process is managed by Paylocity, who shares this information with Netafim. We retain this information for Six (6) years after employment ceases, or Three (3) years after the applicant is notified of rejection.   
  • Participate in a phone call or phone interview: If you participate in a phone call or phone interview, we do not record interviews or phone calls however we may take notes of comments made during the interview. We use these notes for evaluating applicants and for training and education of our staff. We retain this information for Six (6) years after employment ceases, or Three (3) years after the applicant is notified of rejection.     
  • Participate in an in-person interview: If you participate in an on-site interview with Netafim, we will collect, from you, when you register with any of our security desks as a visitor to any of our locations, your sensitive identifiers (drivers license, government identification card, or passport) and video recordings of you captured through our CCTV footage. We also collect video recordings of you automatically via CCTV systems on our premises.    We also collect your picture at a kiosk upon checking in at the facility.   We use this information to ensure the security of Netafim personnel and property. We retain this information for Six (6) years after employment ceases, or Three (3) years after the applicant is notified of rejection.   
  • Information from references: When you provide references with your application, we will receive from your references your professional or employment information (confirmation of details on your resume/CV, certifications, qualifications, employment history, educational history) and inferences drawn from your references, such as their thoughts on your behavior, intelligence, abilities, and aptitudes. We use this personal information to assess your suitability for the position for which you have applied. We retain this information for Six (6) years after employment ceases, or Three (3) years after the applicant is notified of rejection.       
  • Responses to role-based aptitude and skills test: If you complete a role-based aptitude and skills test as part of our hiring process, we collect the responses you provided from our third party test administrator. We use your responses to draw inferences about your characteristics, intelligence, abilities, and aptitudes so that we can match you with jobs and determine your suitability for specific role(s).  We retain this information for Six (6) years after employment ceases, or Three (3) years after the applicant is notified of rejection.  
  • Credit check information: When you apply for a position with Netafim we also collect from credit reporting agencies your credit report (open lines of credit, outstanding balances, auto or student loans, foreclosures, late or missed payments, any bankruptcies and collection accounts, and other information returned in your credit report). We use this credit check to assess your fitness and suitability to the role you have applied for. We retain this information for  Six (6) years after employment ceases, or Three (3) years after the applicant is notified of rejection.

If your application is successful, your personal information will be used and we will retain it in accordance with Netafim’s Employee Privacy Notice which will be provided to you once employment begins. If your application is unsuccessful and you do not become an employee of Netafim, we will retain your personal information for  Three (3) years. after confirmation that your application was unsuccessful, unless you submit a request to us that we delete your application or if we are required by law to maintain it, in which case we retain only what is legally required and only for as long as we are legally required to maintain it. As part of the job application process, we recruit and screen candidates manually, without the use of automated decision-making capabilities.  

Information Collected Automatically by Cookies  

In addition to the personal information you provide or we collect from third parties, when you use our Careers Page, we collect information automatically via cookies and similar technologies.

  • When You Visit our Careers Web Page.  When you visit our Careers Page to look for or apply to open positions, we automatically collect electronic network activity information (Internet Protocol (“IP”) addresses, device identifiers, application identifiers, your interactions with the website such as referring web page, and pages visited on our sites, and information about the platforms, browsers, devices, and computers you use to access the site, including browser type, city, region, country, language, operating system) via cookies.  We use your internet and network activity information to enable site functionality and accessibility, to manage access and provide security, to deliver a personalized online experience, and to provide you information regarding the jobs to which you applied and those that may be of interest to you.

  • Usage information. We use essential, performance, and analytics cookies to collect information about your interaction with our website, such as what you access, what you click on, the frequency of access, and how much time you spend on the website. We use this information to: (i) track you within the website; (ii) enhance user experience; (iii) conduct analytics to improve the website; (iv) prevent fraudulent use of the website; and (v) diagnosis and repair website errors, and, in cases of abuse, track and mitigate the abuse.  
  • Device information. We use essential, performance, and analytics cookies to collect certain information about the device you use to access the website, such as hardware model, operating system, and device preferences. We use this information to: (i) track you within the website; (ii) enhance user experience; (iii) conduct analytics to improve the website; (iv) prevent fraudulent use of the website; and (v) diagnosis and repair errors, and, in cases of abuse, track and mitigate the abuse.  
  • Location information. We use essential, performance, and analytics cookies to collect information about your location, which may be determined through your IP address. We use this information to: (i) track you within the Services; (ii) enhance user experience; (iii) conduct analytics to improve the Services; (iv) prevent fraudulent use of the Services; and (v) diagnosis and repair Services errors, and, in cases of abuse, track and mitigate the abuse.

II. INFORMATION SHARING

General Sharing

Netafim shares applicant's personal information in the following instances:    

  • Within Netafim: We share applicant personal information within Netafim among our hiring decision-makers (i.e. human resources department, senior management, and hiring managers) for the purposes of assessing applications and making hiring decisions. Access to applicant personal information is limited to those on a need to know basis. With respect to executive level positions, we may also share applicant personal information with our parent companies Netafim Ltd., and Orbia, for the purposes of assessing applications and making hiring decisions. 
  • For legal purposes: We share applicant personal information with third parties, such as legal advisors, law enforcement agencies, or governmental/regulatory bodies in order to protect our legal interests and other rights, protect against fraud or other illegal activities, for risk management purposes, and to comply with legal obligations.  
     
  • During a corporate reorganization: In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, we would share applicant personal information. We will also share applicant personal information if we undergo bankruptcy or liquidation, in the course of such proceedings. 

Sharing in the Preceding Twelve (12) Months 

For Business Purposes. In the preceding twelve (12) months, Netafim has disclosed the following categories of personal information for a business purpose to the following categories of third parties: 

  • We have shared applicant identifiers and professional or employment information with service providers that assist us in the application process. These service providers include our background check provider, cloud provider, cloud-based payroll and human capital management software provider and IT support provider.

For Sale.  

Netafim does not sell or share applicants personal information for monetary consideration.

III. RIGHT OF CALIFORNIA RESIDENTS

The California Privacy Rights Act, (CPRA) entitles California residents to certain rights. To the extent the CPRA applies to our processing of your personal information, you are entitled to the following rights:  

  • Right to Access/Know. You have the right to request what personal information we have collected, used, disclosed, and sold about you. This requirement extends to the preceding 12 months; however, the requirement extends beyond the 12-month period if the effort to provide the requested information is proportionate to the person’s request. You may only submit a request for access twice within a twelve-month period.  
  • Right to Deletion. You have the right to request the deletion of your personal information that we collect or maintain, subject to certain exceptions. For example, if we are required by law to retain the information that you are asking be deleted, we would not be able to delete the information until we are legally permitted to delete it.  
  • Right to Opt-Out of Sale/Sharing. You have the right to opt-out of the sale or sharing of your personal information to third parties. Netafim does not have actual knowledge that it sells or shares personal information of minors under the age of sixteen (16) years.  We currently only sell or share personal information under CPRA via cookies. Our use of third-party cookies may be deemed a sale or sharing under the CCPA/CPRA.   • Right To Opt-Out of Behavioral Profiling and Automated Decision-Making: You have the right to ask us to stop profiling and serving ads based on your behavior.  You also have the right to request we not use automated decision-making to provide you with offers, products, or services.   
  • Right to Non-Discrimination. You have the right to not receive discriminatory treatment if and when you exercise your rights to access, delete, opt-out, correct, or limit use of sensitive personal information under the CPRA.   
  • Right to Correct: You have the right to correct inaccurate personal information that we collect or maintain.  
  • Right to limit use of sensitive personal information: You have the right to limit the use of how we use your sensitive personal information. Sensitive information includes Social Security number, driver’s license number, biometric information, precise geolocation, and racial and ethnic origin.

To exercise your right to access/know or delete your personal information, you may submit a request by completing our web form located at https://www.netafimusa.com/privacy-policy/cpra/ or via email at data.privacy@netafim.com.  For requests submitted via email or by using the webform, we require your name, email address, state, country, city, zip code, phone number and if you choose to provide it, your date of birth, you must provide us with sufficient information that to allows us to reasonably verify you are the person about whom we collected the personal information and describe your request with sufficient detail to allow us to properly evaluate and respond to it. In doing so, we will take steps to verify your request by matching information provided by you with the information we have in our records. If we are not able to verify your identity for access and deletion requests with the information provided, we may ask you for additional pieces of information.  

Only you, or a person authorized to act on your behalf, may make a request related to your personal information. If you are an authorized agent making a request on behalf of another individual, you must provide us with signed documentation (e.g. letter or written confirmation)  that you are authorized to act on behalf of that individual. IV. DO NOT TRACK

We will not place cookies or collect information via cookies when your browser is set to Do Not Track (DNT). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

V. INFORMATION SECURITY

We recognize the importance of data security for our customers.  We treat your data with the utmost care and have put in place appropriate security measures to protect the confidentiality, integrity and availability of your personal information from unlawful or unauthorized processing and accidental loss, destruction or damage.  We monitor our network & systems for vulnerabilities and attacks, and also carry out regular testing to identify ways to further strengthen our security.  Although we take commercially reasonable measures to protect your personal information, we cannot guarantee its security.  For this reason, we urge users to take every precaution to protect their personal information whilst using the internet.

VI. PERSONAL INFORMATION OF CHILDREN

Netafim’s Career website is not intended for use by individuals under the age of eighteen (18) years. If we learn that we have collected or received personal information from individuals under the age of eighteen (18), we will delete the personal information. If you believe we have personal information on individuals under the age of eighteen (18), please contact us at the contact information provided below.

VII. CHANGES TO THIS APPLICANT PRIVACY NOTICE

This Applicant Privacy Notice is subject to change at any time. Changes to this Applicant Privacy Notice will be posted on this page and will indicate the date the changes go into effect. If we make any changes that materially affect your privacy rights, we will announce those changes by making a prominent post on our website and obtain your consent, if required.
